7:05 pm Toole Properties 2001, Inc., 439 Pittsfield Road, Map 1 Parcel 33, Review of September 6, 2006 Decision.  Originally scheduled for September 19, 2007, but screening plan, the purpose of the review, was not available. Postponed at the October 17, 2007 meeting because the project is still in the state of construction.

In the September 6, 2006 Decision, a Waiver under Section 10.11.2.7.7 was approved for the screen plan presented for the northerly property line, subject to a review by the Zoning Board of Appeals .  

Present at tonight’s review were Attorney Philip Heller and Joe Toole, the owner of the subject property known as the Hampton Inn.  A site plan was presented.

Mr. Heller explained the purpose of Section 10.11.2.7.7 of the Lenox Zoning Bylaw and stated that there are three circumstances in which screening requirements may be waived.  He cited the third item which states the following:
        
        (c) If said parking facility abuts another parking facility under different use or ownership, a landscaped planting strip at least five feet in width may be used in lieu of screening along the common property line.  

Mr. Toole owns the abutting property which is The Yankee, another motel, and that there is no need for screening.  

SLC made a motion to approve the site plan as presented.  CS seconded the motion and the Board agreed to approve by a vote of 4-0.  PK will write a letter confirming the approval.
